Welcome to JENNIFER CLAIR LIMITED. These Terms and Conditions govern your use of our website, www.jennifer-clair.com, and the purchase of products available through our online store.

By placing an order, you agree to these Terms and Conditions, which do not affect your statutory consumer rights.

You agree to use this website only for lawful purposes and must not interfere with its functionality, security or operation.

Products and Made-to-Order Production

All products available for purchase through the JENNIFER CLAIR website, including our Couture Capsule and Silk Scarves, are made to order.

Each piece is individually produced following order confirmation, reflecting the House's commitment to craftsmanship, quality and attention to detail.

Our products are not held in ready-to-ship stock. Production begins following acceptance of an order and receipt of full payment.

Estimated production times are stated on the relevant product pages and communicated before purchase. These times may vary depending on the product and production requirements.

Due to the handcrafted nature of our creations, minor variations in finishing or appearance may occur, provided that the goods remain consistent with their description and applicable consumer rights.

Orders and Confirmation

By placing an order, you confirm that the information provided, including your selected product, size, colour and delivery details, is accurate.

Following checkout, you will receive an order acknowledgement. Your order will be accepted when we send an order confirmation.

We reserve the right to decline an order before acceptance for legitimate reasons, including product unavailability, pricing errors or suspected fraudulent activity. Where payment has already been collected for an order that is not accepted, it will be refunded.

Pricing and Payment

All prices are displayed in GBP unless otherwise stated.

Applicable taxes and delivery charges will be clearly communicated before the order is placed.

Payment must be made in full at checkout.

We reserve the right to amend prices for future orders. Any price changes will not affect orders already accepted without the customer's agreement.

Production and Delivery

As all online products are made to order, customers should allow for the production timeframe stated on the relevant product page, followed by the applicable delivery period.

The agreed delivery timeframe will be communicated before purchase.

We offer delivery to selected international destinations. Shipping costs and available delivery options are displayed during checkout.

International orders may be subject to import duties, customs charges or local taxes, depending on the destination. Where these charges are payable by the customer, this will be clearly disclosed before purchase.

We are not responsible for delays beyond our reasonable control, but this does not affect our obligations under applicable consumer law or your statutory rights where delivery is delayed or goods are lost or damaged in transit.

Cancellations and Returns

Made-to-Order Products

All products purchased through our website are made to order and enter production following order confirmation.

We encourage customers to review their chosen design, size, colour and product details carefully before completing their purchase.

Although production begins specifically for each order, standard made-to-order products remain subject to applicable statutory cancellation rights.

Your Right to Cancel

For products that are not exempt from statutory cancellation rights, you have the right to cancel your order without giving any reason.

You may exercise this right from the time the contract is concluded until 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.

Where multiple goods under one order are delivered separately, the applicable cancellation period generally runs from receipt of the final item.

To exercise your right to cancel, please notify us by email at enquiries@jennifer-clair.com or send a clear cancellation statement to our postal contact address.

You may also use the model cancellation form provided below, although its use is not mandatory.

Return Conditions

Following notification of cancellation, goods must be returned without undue delay and no later than 14 days after you communicate your decision to cancel.

Customers are responsible for the direct cost of returning goods where the statutory right to cancel is exercised, unless otherwise required by law.

We recommend using a tracked and appropriately insured delivery service due to the value and delicate nature of our creations.

Customers may inspect and try on garments as reasonably necessary to establish their nature, characteristics and fit, in a manner comparable to an in-store inspection.

If goods have been handled beyond what is reasonably necessary for such inspection, resulting in diminished value, JENNIFER CLAIR may make a proportionate deduction from the refund, where permitted by law.

Evidence of wear, staining, damage, alterations or other handling beyond reasonable inspection may be considered when assessing any reduction in value.

Such deductions will reflect the actual reduction in value and will not constitute an automatic penalty.

Refunds

Where a valid statutory cancellation is exercised, we will reimburse the payments received for the cancelled goods, including the cost of our least expensive standard delivery option where applicable.

Additional costs arising from a customer's choice of a more expensive delivery method are not refundable unless required by law.

Refunds will be processed without undue delay and no later than 14 days after we receive the returned goods or evidence that they have been sent back, whichever occurs first.

Where goods have not yet been dispatched, refunds will be processed within 14 days of receiving the cancellation notice.

Refunds will be issued using the original payment method unless otherwise expressly agreed.

Bespoke or Personalised Products

Where a product is genuinely made to an individual customer's specifications or clearly personalised, the statutory change-of-mind cancellation right may not apply under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013.

Any applicable exclusion will be clearly identified and explained before the customer places the order.

Standard made-to-order products are not automatically classified as bespoke or personalised solely because production begins after purchase.

Faulty or Misdescribed Goods

Nothing in these Terms limits or excludes your statutory rights under the Consumer Rights Act 2015.

If an item is faulty, damaged or does not conform to its description, please contact enquiries@jennifer-clair.com so that we can assist you in accordance with your legal rights.

Intellectual Property

All website content, including photographs, text, logos, artwork and original designs, is owned by JENNIFER CLAIR LIMITED or used with permission and is protected by applicable intellectual property laws.

No content may be reproduced, distributed or commercially used without prior written permission from the relevant rights holder.

Limitation of Liability

Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded.

Nothing in these Terms affects your statutory consumer rights.

Subject to these protections, we are not responsible for losses that were not reasonably foreseeable when the contract was made or losses arising from circumstances for which we are not legally responsible.

Changes to These Terms

We may update these Terms and Conditions from time to time.

Any changes will apply to future orders and will not retrospectively alter the terms of an existing accepted order without the customer's agreement.

Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer residing outside England and Wales, you may also benefit from mandatory consumer protections applicable in your country of residence.

Nothing in these Terms limits any mandatory rights you may have concerning the courts in which a dispute may be brought.
